DLBP secures Certificate of Lawfulness and planning permission for roof terrace and railings to mews property

DLBP is delighted to have acted on behalf of a private client in successfully securing a certificate of lawfulness for the use of a roof terrace and planning permission for associated railings to a mews property located within a Conservation Area, in the Royal Borough of Kensington and Chelsea.

DLBP was first approached by our client to advise on how to regularise a roof terrace that had been in use for over 10 years.  Following a review of the site and relevant planning matters, DLBP recommended our client applied for a lawful development certificate to confirm the lawful use of the terrace and advised on the evidence required to demonstrate this.  DLBP also prepared a retrospective planning application to secure planning permission for railings surrounding the roof terrace, which had been installed to improve safety for its users.

DLBP then prepared and acted as agent for both applications, working with Adventure in Architecture to prepare all necessary plans.  Once submitted, we worked closely with the Council (Royal Borough of Kensington and Chelsea) to address concerns raised, in particular from local residents.

Due to the number of local objections received, the applications were required to go before Planning Committee.  Before the committee meeting, DLBP worked hard to ensure the applications were presented with a recommendation for approval.  We then presented to the Planning Committee, on our client’s behalf, and clearly answered all queries raised by Councillor’s such that both applications were approved.
