Biodiversity Net Gain mandatory from 12 January 2024

The Government has recently confirmed Biodiversity Net Gain (BNG) will become mandatory from 12 February 2024 for major developments.

From that date onwards, all applicants for major planning applications (those proposing 10 or more residential units, or 1,000 square metres or more of commercial floorspace) will be required to demonstrate the development will deliver at least 10% net gain in biodiversity to obtain permission.  Most minor applications will have to demonstrate the same from 2 April 2024. This represents a significant increase in regulation and environmental requirements.

At DLBP, we are very familiar with these new requirements and are advising numerous clients on the potential implications for current and future projects.
